Former President Trump Asks High Court Permission for National Guard Forces in Chicago Area
On the last weekday, the White House filed an emergency request to the nation's highest court, asking for authorization to send state guard forces to Chicago and surrounding areas.
This step is part of a broader effort to increase the domestic use of the armed forces in several cities run by Democrats.
Judicial Challenge Over Guard Activation
In an urgent petition, the US Department of Justice asked the judiciary to reverse a earlier court order that had halted the deployment of several hundred state guard personnel to the Chicago region.
The federal judge had expressed skepticism about the administration's reasoning for activating the guard, doubting its reasoning in considering local conditions.
A higher court upheld the initial ruling on Thursday, leaving the activation on pause while the legal challenge moves forward.
White House's Arguments
The top government lawyer, representing the White House, wrote in the new filing that federal law enforcement have often been “threatened and assaulted” in downtown Chicago and the neighboring town of Broadview.
This location is home to an Immigration and Customs Enforcement holding center.
The president has already dispatched national guard personnel to Chicago, Illinois and the city of Portland, following earlier sendings to Los Angeles, Memphis, and Washington, District of Columbia.
The White House has claimed that military intervention is needed to curb unrest and bolster immigration enforcement.
Ideological Opposition
Democratic officials have vehemently criticized the decision, claiming that the White House's statements are inflated and driven by politics.
They accuse the former president of misusing his executive power to retaliate against critics.
The judiciary have also expressed doubt about the government's portrayal of the situation.
Local leaders say that protests over immigration enforcement have been largely limited and non-violent, challenging the former president's description of “battlefield” circumstances.
Legal Basis
At the heart of the dispute is the administration's application of a US code permitting the president to federalize the state guard only in situations of insurrection or when “powerless with the federal troops to execute the statutes of the United States”.
The White House insists that the forces are necessary to protect federal property and personnel from activists.

Previously, the White House took control of three hundred personnel of the state guard of Illinois and directed additional guard from Texas troops into the state.
As local leaders denounced the action, the former president increased his statements, calling on the arrest of the mayor of Chicago and the governor of Illinois, the two Democratic officials, alleging them of neglecting to safeguard federal agents.
State authorities and municipal government together took legal action against the White House to block the activation.
On the ninth of October, district Judge April Perry, appointed by Joe Biden, issued a preliminary order stopping the directive.
